GENERAL TERMS AND CONDITIONS OF SALE
1. Purpose
The following terms and conditions aim to define the legal framework, the rights and reciprocal obligations
between the parties referred to hereafter, which will apply to any purchase made by email, phone, mail or
through the web site www.kjacques.fr
On the one hand,

site www.kjacques.fr,

These terms and conditions concern consumers exclusively and do not apply to retailers.
Any user of the web site declares it has the legal capacity to place an order and use the
payment method selected.
The user can at any time consult the general terms and conditions of sale located in the "information" section
to the left of the screen by clicking on "General Terms and Conditions of sale and use".
When purchasing on the web site www.kjacques.fr it is compulsory for the consumer to accept the general
terms and conditions for confirmation of any order.
When ordering by mail or telephone, the general conditions of sale will apply from the time of the order.
Etablissements KEKLIKIAN reserves the right to change the terms and conditions of sale at any time without
notice. In this event, the conditions will be those in effect at the time of the order.
If any particular clause of these terms and conditions is held to be invalid or declared as such by a competent
court, the other clauses remain in full force and effect.
2. Products and availability.
The availability of the sandals shown on the www.kjacques.fr web site is dependant on the production
capacity of the K. JACQUES workshop. There is no stock kept, every pair ordered is put into production after
confirmation of payment.
The sidelines to the sandals (e.g., moccasins, belts, bags etc....) are available while stocks last.
The order and delivery are confirmed only by us sending an email confirmation from the address
infokj@orange.fr or info@kjacques.fr
The products shown are photographed and described as faithfully as possible. However, depending on the
browser and/ or screen used, the colours may not match the goods exactly.
3. How to order through the web site?
A user who wishes to buy a product on the online shop www.kjacques.fr must:
1) Fill in the identification form, entering all the information requested. A username and password will be
assigned.
2) Select the item(s), or the size(s) and or the colour(s) desired;
3) Confirm your order by emptying the basket;
4) Make the payment in the terms provided.
The order and the delivery is confirmed by:
1) sending a confirmatory e-mail via the address infokj@orange.fr or info@kjacques.fr, advising of the order
going into production,
2) a second email informing you of the date of delivery, the package number and the carrier used.

We are committed to making and fulfilling orders. Failing which, we will contact the customer to offer to
provide another article. In the absence of agreement between the parties, the order will be cancelled and fully
refunded.
We reserve the right to cancel or refuse any order from a customer with whom there is a dispute over
payment of a previous order or where there is any suspicion of fraud.
The order data is stored on reliable and durable computer media. It is considered as evidence of the
contractual relationship between the parties as well as any document, received or kept in writing.
The customer file is exclusively managed by Etablissements KEKLIKIAN.
4. Rates
The price of the items is stated in Euros or in Dollars (United States), excluding delivery costs. These are
shown by default with VAT duties and taxes included. The rate will be recalculated by country of destination
net of tax before confirmation of the order
- Deliveries to mainland France and the European Union:
Rate applied: All taxes included (inc.tax). VAT rate 19.6%
- Deliveries to the overseas territories:
Rate applied: Net of tax (exclusive of tax). VAT and / or other duties will be payable by the recipient to
the customs of the place of delivery.
- Deliveries to countries outside the European Union:
Rate applied: Duties and taxes included. No duty is owed to the customs of the place of delivery.
These are paid by the sender, Etablissement KEKLIKIAN.
The products will be invoiced based on rates in effect at the time of the order registration. The products
remain the property of Etablissement KEKLIKIAN until full payment is received. The price is payable in full
and in one payment.
KEKLIKIAN SA reserves the right to change the prices at any time, except that the price listed in the
catalogue on the day of the order shall be the only one applicable to the buyer.
5. Deadlines and Delivery
5.1 What is the delivery time?
The processing time + delivery is + / - 10 days excluding weekends and holidays
We undertake to reduce these times exceptionally upon request.
All orders placed on the web site until 0:00 Monday through Thursday will be processed and put into
production the next day subject to confirmation of payment. Orders placed on Friday and the weekend will be
processed on Monday.
This period is given for guidance; if it exceeds thirty working days after acceptance of payment for the order,
the sales contract may be terminated at the request of the buyer who will be fully refunded.
5.2 How are items shipped?
The deliveries are made to the address on the order form. Any details below are required:
- Access code,
- The presence of a caretaker,
- Any other information you consider relevant to the proper delivery of the order.
Delivery at the workplace is recommended if possible.
In the event of error or inaccuracies in the name and address of the buyer, we will not be liable for failure to
deliver the order.
The consumer has the choice between a home delivery or parcel service.
Our partner carriers:
1) CHRONOPOST: home delivery in Metropolitan France.
2) FEDERAL EXPRESS (FEDEX): home delivery on signature for international destinations.
3) MAIL: Colissimo Registered Tracked home delivery service for destinations of: -
- CORSICA
- FRENCH OVERSEAS ADMINISTRATIVE DEPARTMENTS AND TERRITORIES.
- ASIA
- Other island countries
4) ICI RELAIS: delivery with outlets throughout France by the carriers Exapaq. Handed over on
signature and presentation of proof of identification of the recipient.
If you want to choose another carrier, you must submit your request by email or telephone. In this case, our
company cannot be held liable for any disputes with the carrier.
The package's number will be sent to you via e-mail address infokj@orange.fr or info@kjacques.fr
, and for deliveries by Chronopost, Fedex and Ici Relais an email or SMS will also be sent by the carrier,
subject to the accuracy of the email address provided by the buyer.
With the package's number you can at any time track progress on the carrier's web site:
- www.chronopost.fr,
- www.fedex.com,
- www.laposte.fr,
- www.icirelais.com,
-Asia and other countries: the country's postal services
5.3 You are away at the time of the delivery?
- The carriers Chronopost will drop a notification card informing you of the status of your package
through your letter box. You must go to the post office or Chronopost agency with the postman's
notice or your parcel number and present proof of identification. The time for holding is 7 consecutive
days from the day after the date of posting the calling card. After this period, the package will be
returned.
- The Fedex carriers post a calling card and wait for the customer's instructions to schedule a second
delivery.
You can also contact them at 0820 123 800 (dialling number from France).
The package will be returned after 6 days.
- La Poste (French Post Office) hands you your package at their office. You must go with the postman's
calling card or your parcel number and present proof of identification.
You can also contact them at 3631.
The time for holding is 15 consecutive days from the day after the date of posting the calling card.
After this period, the package will be returned.
- Ici Relais keeps your package for up to 8 days in the delivery office chosen by the customer when
ordering. A reminder will be sent D +3 by email or SMS if the customer has not come to collect his
package. A second reminder will be sent by email or SMS on D+ 5.
On the 9th day without news from the recipient, the package will be returned.
If the package is returned to us upon receipt we will make every effort to contact our customer and
schedule a new delivery. This will be done through the La Poste Colissimo Registered Tracked
service regardless of the country of destination.
5.4 Delivery problems?
- The original packaging is damaged, torn or open at the time of delivery:
You should note the words "Subject to reservation + ground (s)" and check the condition of the
item(s). Or refuse the package with a note "refused because opened or damaged" on delivery by the
carrier.
You then have a period of three days to inform our company about it. You will need to state in detail
the problem identified (e.g. damaged package, already open...)
- Non delivery of the package on time by the carrier:
You must notify us as soon as possible. We will commence an inquiry of the relevant services and
make every effort to ensure that the waiting period is reasonable.
6. Delivery costs
The online sale of products and services on the web site www.kjacques.fr are reserved for customers
resident: see table.
At the request of the customer, we can, after an evaluation of the cost of transportation, add a country that is
not yet listed to the list.
Delivery costs are automatically calculated and are shown before confirmation of each order.

7. Payment methods
The price is payable on order and in a single payment If paying by cheque, the order will be processed upon
receipt thereof.
Any attempt at fraud, for any amount whatsoever and for whatever cause, will be subject to criminal
prosecution. The complete information about you will be forwarded to the Draguignan Prosecutor for
investigation.
Note that under Article 313-1 of the Penal Code: "Fraud is the fact, whether by use of a false name or a false
status, or by abuse of a true status or by the use of deception, of deceiving a person or entity and thus
inducing them, to their prejudice or the prejudice of a third party to transfer money, securities or any property,
to provide service or to consent to an act of discharge or obligation. Fraud is punishable by five years in
prison and a 375,000 Euro fine."
7.1 Payment on web site?
- Bank card through the Sociιtι Gιnιrale bank's secure system Sogenactif, which uses SSL (Secure Socket
Layer) so that the information transmitted is encrypted by software, and no third party can access the
information during transmission over the network.
- Cheque, made payable to ETABLISSEMENTS KEKLIKIAN or K. JACQUES to be sent to the address:

- Paypal, through their secure web site www.paypal.com which uses the SSL (Secure Socket Layer)
protocol.
7.2 The other payment options?
- Bank card manually:
You can send us your card number, expiration date and security code by phone or fax. This will be debited
within 48 hours. The card receipt will be stapled to the invoice enclosed in the package. We accept VISA,
MASTERCARD and AMERICAN EXPRESS.
The bank card details are destroyed after debit.
- Bank transfer:
At your request we will provide our bank details. You must note your order number in the reference for your
bank transfer and inform us as soon as it set up.
We do not accept cash, money orders and cash on delivery.
8. Right to cancellation
8.1 Exercise of Right of cancellation
The customer has a period of seven days from the date of receipt of the product to exercise his right of
cancellation.
Only products stated as standard (model, colour and size) available on the online store can be the subject of
a refund or exchange.
The product (s) returned (sandals and fabric bags) must be in their original condition, and unused. Upon
receipt of the package, K. JACQUES will decide whether the condition of the returned merchandise is perfect.
No returns will be accepted if the returned products have been visibly used or damaged by the purchaser and
such use or damage makes the product (s) unfit for sale.
If the return is not accepted, the product(s) will be returned to the buyer at our expense without the customer
having any right to seek compensation or reimbursement.
If the customer cancels within the time allowed, K. JACQUES agrees to repay the full amount paid, excluding
the return costs which will be borne by the customer.
8.2 How do I return my order?
The product must be returned within the statutory period of seven days to the address stated in Article 11
hereof, the postmark providing evidence for this purpose.
State your details: order number, email, name, address, phone number.
You must also state whether you want a refund or an exchange.
In the case of an exchange, you must specify style / colour and size.
The order will be returned by the delivery method of your choice.
Retain proof of the package's return since in the event of loss of the package, no refund will be made without
the proof of its return.
8.3 Exceptions
Under the Consumer Code, the right of cancellation may be exercised with regard to personalised and / or
bespoke orders.
Full refund for an order (product (s) + delivery costs) may be granted exceptionally in the cases below:
- Error on our part in processing the order,
- The order processing time is more than thirty working days.
9. Customer after sales service / repairs
The K. JACQUES workshop carries out repairs on the products it has manufactured.
All repairs must be requested in advance.
Do not include any payment when sending your shoes for repair.
Upon receipt of the package, the K. JACQUES workshop will assess the feasibility of the repair depending on
the products' state of wear. Some repairs are charged for (e.g. re-soling), the customer will be informed in
advance and can settle in accordance with our payment options, see item No. 7 "Payment", others are free
(e.g. re-fastening).
The repair will be processed on receipt of payment.
10. Warranty
All products supplied by Etablissements KEKLIKIAN, benefit from the legal warranty under article 1641
onwards of the Civil Code.
In the case of the non-compliance of a product sold, it can be returned to the vendor who will take it back,
exchange it or give a refund.
All claims, requests for exchanges or refunds must be made in advance (see Article 11 "Contact Us").

12. Liability
In the on line sale process, Etablissements KEKLIKIAN is only obliged to use best endeavours, it cannot be
held liable for damages resulting from the use of the Internet such as data loss, intrusion, virus, interruption of
service, or other problems beyond our control.
13. Intellectual property
Any components of Etablissements KEKLIKIAN's web site are and remain the exclusive intellectual property
of Etablissements KEKLIKIAN.
No one is allowed to reproduce, use, redistribute, or use for any purpose whatsoever, even in part, any
component of the web site whether software, visual or sound.
Any single link or hyperlink is strictly prohibited without written consent from Etablissement KEKLIKIAN.
As such, in accordance with the Intellectual Property Code, private use only is authorized, subject to any
different, more restrictive provisions in the Intellectual Property Code. Reproduction in whole or part of
Etablissements KEKLIKIAN's web site www.kjacques.fr www.kjacques.com www.lestropeziennes.com is
strictly prohibited without prior agreement.
14. Personal data
Etablissements KEKLIKIAN does not use the services of third-party advertising companies who display
advertisements when you visit our web site, and does not transmit the information in its customer database to
commercial partners.
15. Archiving, Evidence
Etablissements KEKLIKIAN archive purchase orders and invoices on a reliable and durable medium as a true
copy in accordance with the provisions of section 1348 of the Civil Code.
Etablissements KEKLIKIAN's records will be regarded by the parties as proof of the communications, orders,
payments and other transactions between the parties.
16. Dispute Resolution
These terms and conditions of online sale are subject to French law.
